It also went unchecked because almost no one played this shitty mediocre sequel no one really cares about.

Yeah but what's the visual disparity between the anime girls and the 16 year olds? Are we talking 10 year olds vs. 16? 16 is technically adolescent porn and the distinction is less biological and more legal insofar as the definition of "child". There's certainly a proclivity for the hentai artist to go over the top. It's also why pedophilia isn't the sole term, there's hebephilia, ephebophilia (which actually goes into early adulthood).
There's also legal precedence for using underage models in artistic pursuits in the US domain, if I recall correctly. So meeting the vague definition of art, and especially as applied by those precedents might be more difficult for the VNs or whatever.
