If you read the book it's obvious they don't just sentence him to death because of murder. It's because of his refusal to repent for it, his lack of emotion when his mother died and his general attitude. Of he just said "whoops sorry guess I was a bad boy" he would definitely not have been sentenced to death and maybe even got a light sentence, but he refuses to do that because he doesn't understand it. The prosecutor/judges/jury see him as a weird and dangerous person, almost not human. He is not sorry for murder, he puts his mother in a carehouse and doesn't cry at her funeral, and most of all he can't see what's wrong with his actions.
