That was not an overtake area. Ham did something EXTREMELY stupid if you think about it... would have been very possible that Vet loses his rear in that situation and crashes, possibly taking Ham completely out of it. He would never get penalized though because he kept his line and there was no racing incident because of his action but his attempt to overtake there was deliberate and extremely risky, could have DNFed very easily there. Both drivers are lucky.
