Yeah, but the Gladue principle isn't a "get out of jail free" card or to lessen a sentence. What's your point? The concept of "hard punishment" is a myth and only feeds recidivism even more. The Gladue principle is ordered for restorative justice purposes and to meet the unique needs of a people. "Native social issues" are human issues and the first step to true reconciliation is seeing and accepting this on both sides. Intergenerational trauma is human and evidently Indigenous peoples have a higher rate and that is historic. It is not an excuse to do "wrong" but a reason to the very high disconnect and discontent in Indigenous communities - rural or urban and individually or collectively. I see blame as very counterproductive and incredibly toxic. It is very subtle yet important to know the difference between "excuse" and "reason", as the lines blur often and get lost in confusion. The Indigenous offender also has the right to choose if they want a Gladue principle ordered or not. It is not mandatory. It's also exclusively for guilty pleas.
I'm really sick and tired of the layperson's view on the Gladue principle. I also understand the painful sad fact that "to understand" is simply too much time and energy for a lot of people, time and energy they don't see worthy of, or don't even have.
It really takes a lot of mental energy "to understand" anything - period.
I try to look at things as objective as possible and work through what's what. It is exhausting and hurtful to the soul, to say the least.
