Most people don't know this but technically, sampling literally any copyrighted piece of audio without clearing it is prohibited. It doesn't matter if you release it for free, since it could be argued that you're still benefiting from the views/popularity that the sample brings. So technically, every bootleg soundcloud remix is illegal. The catch is that it's impossible to go after every artist doing this, so unless you are really popular you probably won't face consequences. Even with someone like Vektroid, who's arguably the most popular vaporwave artist, it wasn't until last year that Sony filed a claim for her using a Diana Ross sample
I think where they lose me is when rich artists sue young, non-affluent artists. It depends on the level of sampling too. Frank Ocean's American Wedding and Juice Wrld's Lucid Dreams heavily rely on the original songs they are sampling. Other examples of samples are a lot more hidden and you might not even notice them when listening.
I often wonder if 40 years from now their original songs get taken and re-used for a new genre and if they'll be okay with it.
