If you have a prior dui and you kill someone on a second dui, you get charged with 1st degree murder no matter who is at fault in the accident. That is a clause in the 3-5 year summary probation that you agree to when charged with a first dui. Most teens are going to get off likely on manslaughter because it is the first dui but the DMV is going to automatically suspend a teen if they even blow a 0.1. An adult can blow anything below a 0.4 on summary probation. Kids get off on legal charges because they are teens and that is the first dui, they get off worse in dmv however, they cannot get restricted licenses or breathalyzer car starters, it is only suspension after conviction, which can add up to well over a year. They might have to enroll in the dui program but to no help of getting a restricted license. In terms of what a state would charge they get off because it is most likely going to be the first dui not on summary dui probation. If you are on that an adult will get first degree murder and get a life sentence.

What I meant was, his use of defense with Affluenza, made his life worse whereas if he accepted a manslaughter charge or just pleaded guilty to whatever charges he was facing, he would've been much better off.

If you actually read that case, it hardly resembles what the post above describes. They weren’t let off because they were from good families, they were convicted, 3 recieved suspended sentences, which isn’t an acquittal, and as far as being from good families, they were in an Aboriginal community, they weren’t rich white people like the poster above is implying, and still, not let off.
The judge said the girl “probably consented”, which lead to a whole heap of shit and the government announcing a big review into the whole system, (who knows if that ever amounted to anything). The DPP initially refused to prosecute because he thought the girl consented and after being taken into care, she was sent back to the community to be raped again, before the eventual court case.
All of that is incredibly shitty, but it wasn’t a judge letting pack rapists off, either because of consent or connections.
