this clause doesn't apply to any establishment as they all have their own policy which favors the server by not only letting them keep 100% of their tips, but a fee to compensate servers for inadequate tips is added into the customer's bill

nigger learn to read, I said I have literally never seen this happen in reality or heard anyone complain about it irl. Everywhere, the base wage is at least min wage regardless of tips. I agree that paying below min wage is abusive bullshit, but I don't know of a single place that actually does this.

The staff earn at least minimum wage, but the amount the employer is paying them is well below minimum.
