user, there are 2 types of immigrants in this national debate issue:

"illegals" - who reside in the country illegally
"asylum seekers" - who are seeking asylum

law requires that asylum seekers are considered and if their case is legitimate they are granted citizenship.
Illegals cannot easily prove where they are from or will not. Even if they do, relying on their testimony can be negligent because you don't want to send them to a country that doesn't want extra people either. So you have to address each instance of illegal citizenship with a lengthy process of requesting documentation from likely mother nations.

For asylum seekers, the law stipulates this is not always needed. If there is a provable immediate threat and various other conditions are met, asylum must be granted.

So, if you are already in the country illegally and got here with a valid asylum reason, you ought to stay. That's only reasonable since the border is fluid by nature of how OUR gov't handles it. Asylum seekers are let in first, but questions are asked later. Always.
So in the search for "illegals" you turn up a lot of legal asylum seekers with difficult to establish histories. Usually relating to sketchy documentation from the country they are fleeing.
