The current drug laws are insane and don't actually treat the base issue. People don't use drugs because they are bad people and want to be criminals, they use drugs because that is what they have turned to given their life circumstance and it is how they feel like they need to live to get by. By making these simple possession crimes a felony, you just make the entire process a vicious circle without ever treating the base problem. It is tragic.

In my and most jurisdictions they have to prove the substance that was possessed was a schedule X controlled substance as part of an element of the crime. Without a lab testing the substance (i.e. if they just had a video of you snorting something) they would be unable to prosecute.
