The fossil record seems to suggest that penguins evolved in the Southern Hemisphere, possibly around what is now Zealand. They key point is that they were able to relinquish the ability to fly because there were no land-based predators, like foxes, or polar bears. They then spread throughout the southern oceans. They were not able to reach the Arctic because the large band of warm tropical waters were a barrier, and because predator-free nesting sites were largely non-existent. In addition, their niche (deep-diving predatory seabirds) in the north was occupied by a similar, but unrelated family of birds - the Puffins and their tribe (Alcidae). In fact, there was once a tall, flightless Alcid called the Great Auk that looked very much like a penguin: it was hunted to extinction in the mid 19th century.
