The refs in NJPW are allowed and expected to use their own discretion depending on the situation.

It's not good refereeing, it's probably the worst aspect about NJPW. There should be no cheating without a DQ. I'd like to do away with ref bumps entirely as well.
Outside the ring is no DQ in NJPW. Part of the rulebook.
there's a big difference between ref discretion and doing things like losing by dq in a cage match or repeatedly breaking up pinfalls during an elimination match

You can only get DQd if it happens in the ring. It’s why Suzuki always pulls people into the crowd.
The rules are constantly reiterated on NJPW commentary. You have to be the biggest 17er on planet earth to not get the rules by now.

The count out timer starts at the referees discretion, in high stakes matches the referee will give the wrestlers more time before the count starts because in Kayfabe they dont want to have an unclear/muddy finish to the match when its high stakes
Even when weapons or illegal tactics are used inside the ring, the referee can decide whether or not to end the match, if a wrestler is simply trying to end the match deliberately, the referee can simply choose not to DQ them

The kayfabe reason is that the refs want to see a finish to the match, and so will not call for the DQ unless it's absolutely necessary. That said, it's by far the worst aspect of New Japan. If you know the ref won't call for the bell, what's the point in getting mad at the heels for doing illegal shit? Every time Tama pulls Red shoes to the corner for 30 seconds and then the match just continues it drives me up a wall.
In New Japan it's presented as the referee having the discretion to control the match as he sees fit in order to maintain its integrity. This is properly communicated to the fans and is practiced consistently so its understood and expected.
WWE has rules that refs routinely ignore without any explanation, and there is no consistency.

In the wwe the rules are built to be followed to letter, it is very black and white.
In njpw, they allow for some room to do things that are done under the supervision of the ref.

Cops don't have to site you over for breaking minor traffic laws. They are within their power to use "police discretion" and let it slide because it was insignificant. A better example would be referees in big deciding playoff games like the NBA for instance. Refs will often "let them play" and not call minor fouls or infractions if the game is close because they know having a good and critical game be decided by tight refereeing is bullshit and fans don't want to see that.

NJPW refs will consistently let a lot of shit go on the outside of the ring and Red Shoes is by far the ref that will let the most go in or out for the sake of having a definitive result.
Having said that, it's one of the more annoying parts of NJPW. But it does also lead to great moments like Red Shoes flipping Bullet Club off.
desu I skip big chunks of a lot of Suzuki-gun matches because once you've seen them beat somebody around for five minutes on the outside once, you seen it.
As other anons have said, the stupidity of NJPW refs is probably their worst aspect. It really ruins some matches and makes me wonder why they're even there sometimes.
Anybody remember in WCW where they had a rule you could do anything like wack a guy with a chair as long as you did it outside the ring?
