The 40 remaining nukes are a safeguard against hackers. When a system completely disarms properly the number will fall. When all systems reach zero the phantom nukes will disappear. For instance, when PS3 and Xbox go offline, I bet the phantom nuke number reduces. When PS4 disarms legitimately the phantom nukes reduce further, and finally once all systems disarms legitimately, Chapter 3 unlocks.

To put it another way, the big red light that triggers on Konami King's desk signaling nuclear disarmament doesnt occur at the number 0, but the number 40. Once this triggers, Konami investigates. But seeing as it hit 0, they knew something was afoot and it was due to hacking. It should never hit 0. But if a system hits 40, they investigate, and if its legit, the disarmament is achieved.

little story: I remember getting my N64 the summer of 97. I turned 10 that year and went to summer camp for boy scouts.
