Several years ago I got a fucked up copy of Persona 2 that was listed as "new." The case was broken, the shrink wrap was torn up and barely attached, and it had something sticky on it. Luckily everything besides the jewel case was perfectly fine. I just had to replace it.

It wasn't like this in the past, but now if someone claims that a product was broken, the seller can ask to have it returned at the seller's expense prior to issuance of the refund.
Shipping costs are so high that it's usually difficult to justify, and it's easy to fraudulently return a different item anyways.
ebay favors the buyer 99% of the time, even if youre a reputable seller. you can try to argue with customer support and make a big deal out of it, but unless its something worth a lot of money I dont even bother. even if you give them proof of the condition, the buyer will still be favored if they just say "lol it didnt work fuck you".

for the xbox 360 games that worked this way, you could actually just download the DLC to a usb drive and copy it that way to your console. since the dlc install from the disc was drm free, it still worked.
Never ever buy a game from eBay that doesn't show the condition of the game box and disk or explicitly states its condition in the description (Because the ones that are damaged go in detail about it, even "light" damage I've found). Always assume when anyone states even in the description that it's "lightly damaged" it's had more damage than you think because people think "light damage" is anywhere from a scratch to a hole in the box and light dings on the disk. "Like New" is usually safe provided they show a picture of the box.
If you're buying a game from a Japanese seller on eBay or from something like Yahoo Auctions/Mercari then it doesn't matter, Japanese "used" is effectively brand new and they will go in extreme detail with CSI levels of photographs showing you any defect. I've bought stuff at like $40 discounts because a corner was ever so lightly dinged. Picture related took off $30 from the MSRP of the thing. Japanese sellers on Amazon are kind of a mixed bag though, I wouldn't trust those specifically, personally.
This is why you include pictures from every angle and write in explicit detail what the damage is. "Acceptable condition" is too vague and you fucked yourself.
