They are engaging in the Disney Vault mentality. Having something on the market for a while, then remove it and put it in "The Vault" and don't sell it again for a while to make people interested in "playing it again" when you eventually re-release it.

Issue is, in an era of internet where easy access to secondhand copies exist and especially in this era of emulation that tactic doesn't really work anymore. Nintendo however refuses to accept that this isn't the 80s or 90s anymore and just ignores that all these modern methods that make the vault strategy no longer viable like it used to be for Disney for decades before the Internet became a thing.

1: That's trademark law, NOT copyright law. No amount of "not protecting" a copyright make you lose it. Likewise, no amount of viciously defending a copyright will make you keep it once it's time expires.

2: To lose a trademark the work would have to be diluted enough that it's not even clear who owns the rights anymore or if something is an official product. No fucking idiot is going to download "Super Bloody Mario Shotgun Bros Z" and think Nintendo actually made that.

3: Trademarks have to be very specific. There was a bit shitstorm over King Games attempting to, and eventually losing, the trademark to "candy". This is why some products are intentionally misspelled in an "Extreme" way, replacing a s with a z or so in a common word. You can trademark that intentional misspelling, you can't trademark the generic word.

4: You only lose it that way if the word starts being used in a generalized term. E.G. how people started to refer to copying something as Xeroxing something, or "take the escalator" (Escalators used to be a brand name, not a generic term), etc. Nobody is going to "Download a Mario" instead of "Download a game".
