Because like most systems it only works if everyone plays fair. Misleading advertising is a perfect example of when capitalism fails. You lie in your advertising, people buy your service/product, you got money you didn't deserve and they don't find out before it's too late. You can argue that this business or person will lose money in the future but that's contingent on a lot of things like whether or not you can even get the word out that you were ripped off. Whether or not people believe you. Whether or not they even stay in the same business after providing low quality goods or services. The only way to truly prevent this is business regulations but once you start regulating various aspects of business it ceases to be a truly free and open market.

Because constructing every system around profit maximization first puts only the greediest people in positions of power, quality of life is secondary. Ideally competition will drive consumers towards the better product but in practice any company with capital will do everything in their power to eliminate competition without running into antitrust laws, including lobbying to rewrite said laws. Cost is seen as loss, not an essential part of business, so workers don't get paid and products have their corners cut frequently. A business that merely sells products for fair prices and generates enough profit to stay afloat is considered a failure under capitalism, a successful business must have exponential growth even though logically such growth cannot continue forever.
