Battle Tendency happens between parts 1 and 3 which are essentially one continuous story. 5, on the other hand, does not happen in the middle of a self contained story. Dio is the villain of that story and the fact that his CAPS Lock key breaks during his 100 years in a box doesn't make him a different person. Parts 1 and 3 have the same villain.

Part 1 Dio did not have time powers and was the main villain of part 1 therefore the main villain of parts 1, 2 and 7 did not have time powers, you don't need to have time powers to be the main villain of a part.
