nintendo usually doesn't give a shit about fan-games, especially if they've already been finished and released. since that wave of dmca's starting with am2r i haven't heard about any fangames getting dmca'd which leads me to believe one or more of them may have lied about getting a dmca, certainly mother 4 had nothing to fear since it was using the dmcas as a justification for a rebrand that had clearly been premeditated
