There is one rule, that while not 100% rigid due to the existence of characters such as Duck Hunt Dog and Wii Fit Trainer, still holds up decently strong:

The protagonist of a given game/series has priority over other characters. It feeds into why Marth and Roy were the first FE reps, it feeds into why we got Joker instead of Jack Frost, it feeds into why the first rep of the vast majority of franchises represented in smash are protagonists.

It's not 100% solid, but it does actually exist unlike a lot of other shit.

Joker as an IP wouldn't have happened without Persona 5 the Video Game being a thing, regardless of first appearances. Also, the video games are fully transformative pieces of media in their own right, like Geralt and Dracula, unlike anything with Goku in it which is just "boy I wish I was in the Anime I've already watched." ROB was made as a Toy that could only be used exclusively with NES systems and the IP never broke outside that boundary. The rule of "has to originate from a video game" still would still apply to both Geralt and Joker despite their franchises origins because Smash Bros is utilizing/would utilize Specifically and Exclusively the version that originated from/for a video game release.
