If I remember right, all the lawyer said was some shit about how he personally knew of cases where fangame devs were sued into oblivion and had their houses repossessed or something because they released fangames without telling anyone beforehand, and that he couldn't name them because of legal reasons, conveniently. It's a million times easier, I've done it. Knowing exactly how everything is supposed to work from beginning to end makes an insane difference. I've never been able to make something original and probably never will.

At least someone isn't missing the point.
Once it's finished and released, Nintendo can C&D all they want.
The files are out and on the net, and they can't stop people from playing it anymore.
The only way a C&D matters is if it stops the devs from finishing their fan game, or if the game relies on servers to function.
