Court of law is just a bunch of people enforcing their arbitrary rules and social constructs. It might be a fact that they'll punish you for doing something with B-K that Microsoft doesn't approve of, but it still isn't a fact that the IP belongs to them just because they say so.

Considering both Joker and Hero were obviously included at least partially to help promote upcoming releases, it's probably safe to assume that something similar could happen with Banjo.
