That's not how copyright works, unfortunately, for the reason reason as Batman, Mickey Mouse, Superman, etc are not all public domain right now.
Because of companies like Disney getting laws changed, windows of time and stipulations on copyright have been juggled around so much that public domain will likely never hold the characters you'd like it to, big companies make sure they get to retain their rights over them. Mario will not b public domain for as long as Nintendo, those who own the rights to the character, continue to use the character in new IPs. Until 75 years after the last Mario product has ever been created, he will remain their property.
