It was never a rule but keep in mind that it's probably a lot harder to negiotate for western owned characters across the globe, than it is with local companies like Capcom or SEGA due to Sakurai being situated in Japan.
The other western designed characters in the game (Dark Samus, K. Rool, Diddy Kong) don't have this issue because they're owned directly by Nintendo, despite being made by western hands. Even Shovel Knight, who got an assist trophy, had his game published by Nintendo in Japan.
So in that sense, Banjo & Kazooie feel like special exceptions because of both their fan demand and their history with Nintendo back on the N64.

What about a "pure western" franchise.
That is to say a game franchise which has absolutely no affiliation with a Japanese company what so ever.
Banjo is still technically of Japanese origin despite being created in a western country. As Rare was a subsidiary of Nintendo which is a Japanese company. So in a sense Banjo still falls within the rules of "No western characters".
