Nowhere in the Blizzard TOS is a condition that says something like "you allow that third parties can broadcast your messages and your names as well as monetize what you are saying and doing". The only reason no streamer was sued is because those people who are playing have to sue. Maybe in the USA you can get millions, but in most other countries the court will ask (in a civil case) about the value of the damage (which is pretty much nothing). You won't get any money, but the streamer could be punished, but there is no case in which a streamer was sentenced to anything because of invading and violating your privacy, so if you sue a streamer you will be maybe even the first case in court and it will be a shitty court experience.

The best thing to avoid streamers is simply saying nothing and choosing a name which is saying nothing (like naming you Jeff or like other devs from wow). If you don't know a person don't talk more than the normal "ty" or other stuff which says nothing about your. Always assume the person you are talking to is a streamer.

Cross faction collusion on PvP servers is against ToS so if they're blacklisting people on other factions for what they did to a streamer, that's very against the rules.
