Companies don't care because they gain more sales from the free advertisement than they lose from people only watching. That's the benefit of the medium. Some movie games don't want you to stream them though but they're an exception not a rule.

I like to watch CSGO tournaments. I don't understand watching a streamer besides that though. I tried to get into it but just didn't find it entertaining to watch someone else play a game when I could just go and play that game.

Let's also say that streamer gained 100 subs in that 5 minutes, that's only $500. So now what? YouTube is going to use their multi million dollar legal team to go after $500? Even then they have to prove that the $500 was somehow lost wages. Not only is that the most uphill legal battle ever, it's also not worth the thousands of dollars you'd spend in litigation.

Before it became a fempire, Twitch had the problem of audio levels being set way too low across the site.
The ads play fine. The top tournaments play fine. But everyone else is far too quiet. It's not just the Twitch player; when a Twitch person uploads their gameplay to Youtube the video is too quiet there as well.
I have no fucking idea why, but Twitch as a whole has this meme of low audio levels.

I think it's bad for the reason you just stated. "Twitch bait" is a thing, and many game designers are trying to make their game more suitable to streaming as the entertainment value and not gameplay.
