Damage isn't enough, you have to prove actual malice, that you're purposefully trying to destroy someone's reputation. If you give a controversial opinion and it causes people not to like thing anymore, or even causes someone to lose their job, not enough. You basically have to want to destroy their life. And fuck, if the random MAGA teenager got their libel/slander lawsuit thrown out (which as a lawfag I thought was probably the only truly good libel/slander case I've seen) then it is basically impossible for one to succeed. Plus, tort reform has made it so even if someone does have a plan to ruin your life, you prove it, and you prevail in court, you're not going to get enough money to compensate you for your losses.

The standard for libel/slander cases is basically so high that it is borderline impossible unless someone runs a targeted smear campaign saying that you rape children daily and does it even though they know it isn't true. You need to make a statement with reckless disregard of its truth or falsity. You basically have to get inside the person who made the statement's head and see if they made that decision, which is nearly impossible.
