Bayo was busted in 4 because she was the only character with long kill combos in a game that had jack shit for combos besides throw-to-aerial, Sheik, ZSS stun confirms, and Ryu (notice how those were also Top Tier in 4). Ultimate's system changes hurt Bayo much more than her moves getting nerfed.

Hero's only really fucked up thing is Critical Hits but you might as well just consider them a difficult sweetspot that any player would only land as often as the Crits occur. The menu is randomized and is full of weak/worthless spells, plus your opponent can literally see your choice and work around it. He's going to be very threatening in the hands of the type of player that makes Faust threatening in Guilty Gear, but broken on the level of 4Bayo/BrawlMK is just not feasible when the worst things are RNG instead of just something you can do whenever you want.

But why people are worried about him is because he has several moves that KO you while you're at 0%. While that does only happen depending on RNG and being situational it also kills the mood and pacing of the fight. So while you could be stomping a Hero if he ended up with a good RNG spell you've just lost a stock through a seemingly unearned move
And beyond spells like that there's also just the random crit kills from normal attacks

Hero is a character that keeps you on your toes because he's full of different ways to kill you, not just from spells but from crits alone and that's making players antsy

Give it time, Hero will likely be high tier but no character that ever relied heavily on RNG made it to the top of a tier list. Plus a lot of the good moves are either long range and not good up close or they require you to use DownB in someone's face which is risky.

Literally the rarest down b spell in the game at 4%, has a high chance of being useless or instakilling you (kamikaze, slowdown, and sleep are pretty much instadeath).
It's his worst spell and completely competitively unviable unless you're up or down a huge amount and want to do it as a meme.
