IT would ruin the integrity of the game. It makes his results inconsistent and not in a good way. People who compare a smash attack randomly doing way more in % and knockback to GW/Luigi/Peach are retarded. Hero failing to get a crit does not negatively impact him in any way-- GW and Luigi are often negative on hit for not getting a 9/misfire and Peach has to not only pull the turnip, but then land it (and you can catch it WHILE counterattacking). The smash attacks here look relatively similar in framedata to Link.
Let's not also pass up the ability of Hero to recover from literally anywhere (also tied to RNG). Since snooze hits in the air, it's plausible there is some sort of soft hit cheese to a snooze attempt for a low % offstage kill, or just a free edgeguard attempt that if it hits is a full stock loss from any %. Doesn't come up? Don't worry, he can look for a buff or heal himself 11% in the meantime. >But but this all needs MP! It does, however he has zero reason to ever approach. He can heal himself, he has anti-zoning tools (his shield + spells), and he heals MP at a pretty good rate without going in. Will he be OP? Who knows? We'll see. Will he be annoying as fuck to play against and encourage both running away and going all in on attacks? Yes, yes he will. Hopefully he winds up so middling that he isn't seen often.

At least g&w's judgement is RNG, it's a completely high risk high reward move completely out of your control. The hero has four different options every time he starts his down special. If he doesn't like those he can simply re open the menu. For g&w to get a nine, he has to swing his hammer again if he got a nine before (because the same number can't repeat twice in a row for his judgement.) The hero's down special is like if g&w could choose whichever number he wanted at the time.
