He has to face justice. You cannot argue that he "hurr he good now though". The right thing to do is pay for your crimes even if you regret them and have moved past them. If you murder one person and later think it was the wrong thing to do, they don't let you out of prison. Even if everyone believes you truly regret killing, no one thinks you should be let out because it's unfair to the victim to not have justice. If you accidentally kill someone even, you're still sent to prison. It's about being fair and just. Paarthurnax is a bro, but he regrettably needs to pay for his crimes in one way or another. If he was truly good, he would understand this and would willingly allow himself to be executed or would negotiate on some other (fair) punishment.
Furthermore, since Paarthurnax is not wise enough to understand this, he may not be wise enough to permanently abstain from the dragons' natural urge to dominate.

Physically he is the first and most powerful but at the same time he is also part of the Aka oversoul just like akatosh is, making him in a similar tier. Him being the son is more metaphorical since him and Akatosh are dragons and he comes after Akatosh, making him a "son" of his. c)If the fulfillment of the law is to protect the community and bring about security and confidence to society, then punishing Paarthumax serves no purpose, as he is neither dangerous nor harmful now, his self imposed exile and reflection served the same purpose the punishment would have.

Sadly no. Bethesda had the chance to add the choice in Dawnguard or Dragonborn DLC, but nooooo they're either too afraid or lazy.

Killing Parthunaax is a bad thing to do. He helped us, he guided us, arguably more than the Blades ever did. I'd rather be a Dragonborn that didn't kill all dragons than a Dragonborn that killed his friends.
