I think for an MMORPG it's too hard to nail down the setting. Are players students at an academy or are they adults in the wizard world? If they're students that really limits what you can actually do with the game. If they're adults then it feels stupid to even use the HP license. If they can be both then the setting is disjointed. Is combat central to the game like it is in most MMORPGs? That seems to take something away from the whimsical bullshit that Harry Potter is known for. If it isn't then what are players actually doing besides jerking off in a sandbox? That gets old after a couple of months and you need a reason for people to keep coming back and paying.
I think most things you could do with a Harry Potter online game are better done with an original IP that's essentially a knock-off.
