Microsoft doesn't own Banjo-Kazooie. Rare wasn't fully absorbed into the company, it's a subsidiary of Microsoft and for all intents and purposes anything that Rare made is entirely their own even now.

Well, you could make an argument for a few other characters, but I think they'd just be replacing ones in the picture already. I think people go with Heavy comparatively because Gordon is much more mundane, which makes it harder to make a unique moveset that only he could have. The gravity gun can only do so much. You have to admit there's definitely an issue of language barrier and logistics when it comes to including western characters.

It's just much easier on Sakurai's part to negotiate with local Japanese companies rather than english speaking ones on the other side of the world. Diddy, K. Rool, and Dark Samus, despite being designed by western hands, don't really have this issue because they're owned by Nintendo. Even something like Shovel Knight appearing as an assist trophy makes sense when you consider that Nintendo published his game in Japan.

Banjo & Kazooie are a special case not only because of overwhelming fan demand, but because of their history with Nintendo, as they published their N64 outings just as they did with Rare's DK and Star Fox games and the Metroid Prime trilogy.

That’s generally what I’ve heard and it makes sense considering how the initial transition from Nintendo to Microsoft happened, but I don’t understand why Microsoft appears in the copyright data for smash ultimate instead of Rare, if this is true.
