She's the deuteragonist (but most marketed and recognizable character) of Xenosaga, a IP created by Monolith Soft (the people who created Xenoblade). Technically, Xenosaga is a completely different IP from Xenoblade with no relation legally, and is owned by Bamco instead of Nintendo.

The fact that KOS-MOS is both a Bamco character, technically from a different IP, while still making Nintendo appearances gives her the highest chance of any Xeno character to be smash DLC. Elma and Rex&Pyra are deconfirmed.
Also Xenosaga 1 is the best selling Xeno game on paper, though Xenoblade 2 probably surpassed it in the last month or two. There's strangely zero mention of Xenosaga in Smash despite having a history with Nintendo and being a Bamco IP, making people assume it's being saved for DLC.
