But it's arguably not as wrong as cheating in a game that people actually pay money to play (e.g. Xbox Live, or even most PC which are either bought or where players have invested money in microtransactions).

So I'm not sure I buy your argument - although I definitely understand why a dev would want to keep his game free of hackers for the sake of ordinary players. Not sure if that's going to be feasible. You know at the beginning of the game when that circle spins before you get to the lobby? I'm pretty sure that's the game connecting to the server. Once it sees your IP and checks if you're banned, it will then put you in jail if you're banned. I even found a connect() function in the code and, sure enough, it does the same thing. Once you try opening the connection, it will check your IP, and put you in the jail if you've been banned.

You could enter some code to find that variable automagically, so you don't need to keep updating the script. E.g. something like:

Would the real dev really risk getting sued to hell? Could easily be sued for damages as well as arguably the profits (Patreon donations) accrued from this IP theft. I have received no response. He is still clearly using Twitter because I can see his tweets that are much more recent than my message.

I could message again saying "listen friend, I'm considering reporting you to Nintendo", but he probably knows it's been done to death anyway. And blackmail isn't a good way to foster good relations, so that's another reason for not doing that.

But yeah, if there is no chance of getting back on this game, and if the guy is just going to be a cunt about it, then sure thing I'll send another email to Nintendo and be as detailed as I can be.

Well here's my argument:
1) Every service I can think of, e.g. Xbox Live, has a terms of service which WARNS you of the consequences of hacking. And Yea Forums has a list of RULES that you are advised to consult before posting. So like I say, nearly every service has WARNINGS and explicit RULES.
2) Mario Royale is a free service, much like Yea Forums. And on Yea Forums, you get warnings in some cases, or temporary bans in many other cases. Permanent bans are extremely rare, I believe - I've not had one in 10 years - and I would assume they only exist for the most egregious contraventions of the rules (there's that word again - rules, codified rules), e.g. CP I would imagine. Xbox Live on the other hand can, I believe, permanently ban your account upon cheating - but Xbox Live is a paid service, where other gamers have paid money for a quality service. Also, Xbox Live only bans your account initially I think - so you'll lose your gamerscore, but you can create a new account. Only after repeated and egregious offences do they ban your console. And, like I say, Xbox Live has codified rules which everybody is aware of before they start playing.
3) Temporary bans for cheating, fair enough (I still think warnings / written rules that explicitly detail this penalty would be a good idea, too). But permanent bans, with no warning, seems a bit megalomaniacal.
