If you have such an overwhelming advantage and still can't get the check mate you don't deserve the win.

Take rooks instead of queens, it's much harder to lock yourself into stale mate and a rook+king is all you need to get check mate.

Yes. If they have a king and you have two queens it is so easy to win that if you accidentally put your opponent in stale mate you don't deserve the win. It also gives the opponent incentive to keep playing, since if they maneuver themselves right they can get at least a half point in a tourney instead of a zero.

The rule has changed with the history of chess but its always a lack of legal moves.
At some points it was a win for the stalemating side, at one point a half win, rarely even a loss for the one administering it.
