Big companies like Microsoft tend to horde IP properties they have zero intent on using. Even if Nintendo DID want to buy Banjo-Kazooie there is no guarantee Microsoft would go for it.

I imagine Microsoft's reasoning might be that if they sell the Banjo IP they won't get much for it at all... a couple of millions probably.

To Microsoft the risk is that Nintendo takes the IP, makes a brand-new amazing game that sells tons of money and now Microsoft looks like a bunch of incompetent chumps to their shareholders for losing a valuable IP.

Imagine if Warner Bros owned the movies rights to Marvel and sold it to Disney before the MCU happened. Nowadays they'd look like a bunch of retards.

Less risky to just hold onto the IP and do jack shit with it.

The best option is to sell it to an autistic developer with some of the original devs who've taken notes on what made the games great, showing competent results and releasing it on both switch and xbox with crossplay capabilities.
It's a absolute stretch but literally the most hopeful outcome. Microsoft owning it means it's never getting used. Nu-Rare making another BK game is the biggest monkey's paw. Nintendo owning it means shit like this while probably being watered down in comparison to the previous N64 titles.
It's a franchise that's 20 years dead. Recapturing the vision and delivering on the hope of the third game needs to be done absolutely right.

Banjo-Kazooie was actually owned by Nintendo before the buyout.
They gave so little fucks about it they just gave it to Rare when they went with Microsoft; in exchange of Chunky Kong, Lanky Kong and Tiny Kong.

Fuck Banjo & Kazoooie, Nintendo should pick up the Blinx IP Microsoft abandoned years ago and make a new game from that. Much more interesting possibilites and much cheaper.

Nostalgiabux is a fickle market, they don't want to take the investment just to end up with a game that doesn't sell because everyone got over the honeymoon phase like a month or two after the announcement.

It'll lack that cheeky Brit charm that Rare was known for, though, and that's part of what gave the series its identity and memorability.

Nintendo already owns a considerable portion of the Pokemon Company so they might as well have joint ownership.

We all know they won't give it the Mario treatment, they are gonna either half ass the game, or pass it to someone else who will either make a worse game or better depending on the studio. The only studio I would trust with Banjo is Retro, but they have so much on their plate as it is.

This isn't completely true. Banjo-Kazooie was always a Rare-owned property, but Nintendo at the time owned 49% of Rare, with the other 51% belonging to the Stampers. They had some kind of contract where they would work exclusively with Nintendo for a few years, where at the end Nintendo would have the option of buying them outright - however, Nintendo didn't end up following through, for whatever reason that might be. The Stampers shopped around and sold their shares off to Microsoft, after which Nintendo sold their stake in Rare to Microsoft since they didn't want minority ownership of a studio owned by a competitor.

I don't know the specifics of how the rights to the DKC games works, but the IP itself is and always was wholly owned by Nintendo - every character, song and location belongs to them. I assume Rare/Microsoft are entitled to a cut of the sales, though, considering Phil Spencer said that they work with Nintendo when they want to re-release those games. All DKC games are Nintendo-owned, though, with the exception of Diddy Kong Racing, which was developed as an installment in Rare's R.C. Pro-Am series and got Diddy Kong branding at Miyamoto's suggestion/approval, but whose ownership Rare retained.

I feel buying the IP would change little outside of guaranteeing Banjo would return in future Smash games. (Judging by what Phil Spenser had to say on the topic, it wouldn't be a big deal anyway). Nintendo's also allowed many good IP to collect dust. Pic related, Advance Wars, Golden Sun. Nintendo would probably make one game, and if it doesn't sell 2 million in a year, it's dead.

That also probably isn't true. I've heard the story as well, but I think it was just one exec among many sent to visit Rare that wasn't overly-familiar with video-games, who saw the Donkey Kong merch they had around and assumed that it meant they owned that as well. I don't think Microsoft went into it genuinely thinking they were buying DK when they weren't.

Because Nintendo has pretty much zero use for them aside guest starring in Smash. Nintendo owns a lot of popular mascots already, far more popular than BK including their flagship series.
Look at this way, Nintendo would have to buy the IP and would have to put money and effort for the IP to sell well including promotion and having a team dedicated to it. It's a lot more of an investment than creating a new IP from scratch.because at least with the new IP you don't have to pay for it and the team working on it acquires a sense of ownership to the IP.

Diddy Kong Racing is actually more-so in legal limbo much like Goldeneye. Nintendo owns Diddy Kong and the game itself, while Rare owns the original characters and Banjo and Conker.

With DKC and DK64, Nintendo owns the characters, scenario, music, etc of the games, but Rare owns the code of the games.

Nintendo never owned any part of BK, Conker, Battletoads, or Perfect Dark.

Maybe Tooie, but you can beat every level in BK in one go IIRC. All the powers you need are contained within the levels. So no backtracking required other than to fill in paintings earlier in the lair

Look man, I fucking love Banjo, but the Rusty Bucket Bay engine room proves you completely wrong. The entire reason that room is considered a total nightmare is because of how clunky and slow the actual platforming in Banjo-Kazooie is, and is also the main reason why there's not a single other area in the game with platforming like that. The game would be borderline unplayable.
Meanwhile if you ripped that room from the game and stuck it into Mario 64 or any other Mario game it would be an absolute cake walk, because those sorts of obstacles are standard in Mario games and his moveset is designed to overcome them.
You need to accept that both SM64 and BK do some things better than one another, neither game excels in every area and there's honestly not a lot of overlap.
