No, I literally don't think Kirkhope would be contacted because he doesn't own the music he did for BK and Nintendo doesn't need his permission or involvement to use or remix it. Nintendo already didn't do that with any of the other remixes that made it in Smash. If the original track isn't owned by the composer or Nintendo isn't already working with said composer, they don't have to and likely won't bother contacting them. Same shit with Rare themselves. MS owns them and their IPs and Rare's involvement isn't required in any way shape or form so they don't need to know and very likely won't. Nintendo wants as few people to know as possible so why take the risk in letting people who don't need to know in on it.

I'm not sure it's exactly like that. These things are complicated. regardless of that though, you are correct that there is almost nothing nintendo needs from Rare. For Joker they did need to cooperate with Atlus because a lot of animations are copied directly from P5. same with Bayonetta. for banjo the animations and character models are so old that there's no way they would even be adapted or touched up at all to be reused now. Sakurai's team will do everything from scratch. I think Phil Spencer first said he would be cool for banjo to appear in smash in 2014 or 2015 and it's possible he got permission back then from Rare and there's been no involvement with Rare since then.
