I think a Battletoad is the most plausible one. I'd love banjo but who knows, Rash has been much more prominent recently.

I can argue Rare already have reps in Smash in the form of Donkey Kong Country characters. They're the ones who literally defined Donkey Kong as a character and a gaming IP. So much so Microsoft themselves even thought they snatched the rights to Donkey Kong as a byproduct of their acquisition of Rare. That's how tied to Rareware Donkey Kong is.
But for a Rare rep not owned by Nintendo, Banjo Kazooie would be their best choice.
The arcana
Donkey Kong is already the perfect rep for Rare really. DK 64 was a better collectathon than any of the BK games, and DKC was pretty much the pinnacle of Rares work on the SNES. The only thing that sets any of these other franchises apart in terms of "representation" is that they are still owned by Rare. All that does though is make legality more complicated and doesn't make representation any better at all.
