The law doesn't care about the creator, it cares about the owner. Nintendo owns K. Rool and Diddy Kong, they can do with their own characters as they please. They cannot put Banjo in the game just because the same people made them.

In fact, there is precedence for this. Rare themselves remade Diddy Kong Racing for the DS. However their characters Banjo and Conker were removed, replaced with two other characters they made that Nintendo owns: Dixie and Tiny Kong. Even when working with Rare themselves on a title they made, they did not use the Banjo character.

It seems you didn't even read the article nor the other post.
Sakurai explained that he used the ballot for Ultimate's base game. At least 15 of the 19 characters who weren't in Smash 4 came straight from the ballot (Inklings, Daisy, Ridley, the seven cut veterans, Simon, Richter, Dark Samus, Chrom and K. Rool, and maybe even Isabelle). The last three characters (I'm including Piranha Plant since it seems it was intended to be in the base game, given the spot it has in the files, being placed between Incineroar and K. Rool) were definitely not taken from the ballot. Joker was definitely not taken from the ballot since Persona didn't appear, not even Jack Frost from SMT.
