In most 90% of cases, it is:

-saturation
-low poly/2.5d sprites
-naturistic sound
-a feeling that the game was was made by excited optismistic or ambitious devs

and some other crucial element I can't think of

Soul is a good and creative art/sound design. Unique and inspired. Doesn't have to be an old game or nostalgia either.
Modern games with soul include games like Destiny for example, which is very good in its presentation
