I'm sure most devs don't give a shit if people host their own servers after a game dies, it's the publishers that stop them because A) there's no money to be made in letting everyone know how your servers work and B) they think people hosting their own shit is cutting into their profit.
Point B can be seen in blizzard smacking down private servers over and over until they realized that forcing people to buy the new expansion wasn't working and that they've been sitting on a huge pile of (potential) money by not hosting legacy servers in the first place.
A company shouldn't be able to keep a game dead, so I do hope something gets done about this.

GAAS is a broad term that describes many things.
MMOs have literally always been GAAS, any game that gets post launch support free or paid is technically GAAS, and any game part of a subscription service like PS+, PSNow, Gamepass, EA/Origin Access, Stadia etc is also GAAS.

Software is treated differently due to the fact that a perfect copy can be made near instantly and nearly without any limits on how many can be made unlike a physical good. That is why you can sell any cartridge or disc you have for a console and be fine as you are losing access to said software, however you cannot resell digital downloads unless that license is revoked, like how steam does it. You will see this become an issue if 3D printers get more sophisticated and widely available.
I've told people that you aren't buying the software, you are buying the license key to access said software. While I'm not a fan of where the industry has been heading and will head, it is the natural outcome of content owners trying to make money off of their content while trying to fight piracy in the process. They want strict control of how their content is consumed(started with how VHS and cassette tapes were handled in the 70s). While it wont outright prevent piracy, if gaming and media goes full on streaming instead of actual installing it, it will surely put a dent in it. Unlike YouTube or any other streaming video/music where a person can "download a stream" and save it, streaming a game would be near impossible to copy and install on a local machine as you aren't getting the actual data for the files, just the rendered image.

GaaS is just a marketing term, everyone is doing it differently and for different reasons. To say it is fraud is painting with extremely broad strokes and doesn't mean anything. Some services may be fraudulent, but not every implementation is. There's no black and white simple answer to this.

Not being able to financially keep the game running on a server is not a 'defective product'. If in the End User Agreement it says that the game could stop working at any moment (Which they always do) then there's no legal basis for this.
It might be scummy of EA to shut down servers just a couple of years after release, but it's all in the EULA. In their defense, they support AAA games with millions of players and servers that need to accommodate those users. When the game is not making money of course they will shut down the servers. If you're already made aware of this in the EULA I don't see how you have a legal leg to stand on. If you agreed to the EULA, you accepted this.

Good, successful games also get shut down eventually, and they don't have to. Code doesn't wear out or degrade. The error is in believing that games rely on publisher-run central servers. That's an artificial requirement imposed on the product you were sold so that the publisher can revoke it when they're ready to sell you the next one.
