It's the Hammer from the past before Odin died. So even if his inscripiton stopped working after his death which is up for debate, it's 2013 Thor's Hammer so it still works the same as it did back then. Cap is what changed, he is now fully worthy because he admitted to knowing what Bucky did in Civil War. He is now completely worthy and it obeys him, Thor, and whoever else is worthy by Odin's standards. They can all call it to them and use the lightning powers with in it.

So Universal needs to play ball for that to happen and obviously Disney doesn't want other studios in on it, so instead of making Hulk films, it's more logical to make other films that feature Hulk characters in starring, but none title roles.

Before you bring it up, Spider-man is a different situation entirely. Sony has distribution and the rights to the SM characters, so the only way those movies can happen is by Sony continuing to let Marvel make the movies for them.
