It's fine as long as you're careful about what you promise. Though this actually works best on Patreon as there's no product that you have to promise to release, just an inferred promise to work on the project while being funded.
Basically, as long as you deliver all of your Patreon goals to the people then you're good. This just means only promising to deliver stuff like progress updates and community accesses, shit that literally anyone can deliver with ease. If you do promise a game or access to a game then just make the lowest quality thing that could be counted as the game you promised, so be vague about the features and contents.
If you do all that then you're legally in the clear even if you clearly never had any intent of delivering a finished, high quality product.

If a good lawyer pressed her lawyer, I wonder what the excuse would be for what this contract entails on her end. You're still not getting it. If the claim is "credible", it's not up to a judge to prevent a credible case from going to trial. A grand jury is similar to this. In a civil case, a judge looks over the case and gives a simple yes/no if it can go forward. In a criminal case, a grand jury looks ove the case and gives a simple yes/no if it can go forward. The philosophy in US courts is that if a complaint is credible, the judge must allow the case to go forward so a resolution can be reached before a court. It's not up to the judge to pick and choose. It's why the USA is known for being so sue happy. Also, in a US court room, EVERYTHING pretrial ultimately comes down to the judge (or a grand jury) and their opinion. It's why recusal is so important in US courts.
I'm not arguing that these guys actually owe their doners anything, I'm simply stating the fact that if they present their grievinces to a court, the judge can allow such a case to go forward into the discovery phase. At which point Patreon would be required to hand over the information or face contempt of court charges.

They weren't selling the mod just collecting donations to run the closed beta servers. They got more money then needed. So most of the money that comes in just sits around doing nothing. The skyrim together team doesn't really owe anyone anything since they've worked om this mod voluntarily for free for ages. Everyone in this thread is acting like it's been paid for the whole time, but these donations are actually recent as a result of closed beta being granted with a one dolar donation. So the skyrim together team provided evidence of the product working now all they have to do is finish it then put it in open beta.
