Sales 100% don't matter, as Monster Hunter and Resident Evil have sold more than Megaman and Street Fighter, yet both were in Smash 4 before MH was as a mii costume. Therefore, it comes down to a character's recognizability and potential.
Monster Hunter is represented by Rathalos, as the series was always about the creatures you battle and not about who you play as. Most likely to return as mii costume.
A Resident Evil rep would be incredibly similar to Snake and more specifically Joker. If a rep was planned, why would they give Joker so many similar moves first? Likely to be a mii gunner outfit, yet still has a chance.
A Dead Rising rep faces the same issues as a Resident Evil rep, as both fall under similar archetypes. Unlikely to get anything.
Devil May Cry could be represented, but Dante has already been deconfirmed essentially and would fall into the same niche Bayo already covers. Mii outfit.
Okami could be represented as well, but would be generally unrecognizable and therefore not a priority as DLC. Unlikely to get anything.
Now Phoenix...Capcom has been pushing him hard recently. From the anime to the trilogy release on new platforms previously untouched by the series, it is evident that they are attempting to bring Ace Attorney into the public eye. Phoenix has incredible potential for a dynamic moveset, would represent the visual novel genre, and even if the main demographic recognizes him as the "objection man," it's that recognizability that will sell. I'll admit that I only bought and got into UMvC3 because Phoenix Wright was announced. I would probably do the same for smash. Though to be honest, a part of me wants Monokuma more than Phoenix Wright.
I'd be happy with either in Smash, but honestly Monokuma would be a very odd choice and wouldn't fit in as much as Phoenix.

I really don't wanna bring this up because I've been also really hoping for Phoenix Wright but it seems like he's not a part of DLC pack. Kamiya's December tweet kinda deconfirmed it. In fact I think a Monster Hunter rep has the biggest chance among all third characters.
But don't lose hope yet the DLC pack 2 still can happen. I saw Sakurai tweeted about Layton x Ace Attorney in the past. at least he cares about the series.
