After adding Snake but before adding Sonic, Sakurai said that it was something of a "courtesy" to have appeared on a Nintendo platform when talking about adding another 3rd party to Brawl. People ran with this meaning "important to Nintendo history" (which Snake never was) and other shit when really it was implied to mean little beyond a basic filtering mechanism for a million potential character requests. When it came for the reasons why Sakurai added certain characters they were less about Nintendo fidelity. Joker in particular appeared on 3DS so is kosher.
