So far Nintendo has kept to their word, only enforcing developers to abide by the regional regulatory rules setup by the ratings boards. For instance, the re-release of the 1995 Sega Saturn game, Super Real Mahjong PV, had a nipple slip in the Nintendo Switch version that didn’t comply with Japan’s CERO system. So CERO and Nintendo informed the developer Mighty Craft about the issue and they proceeded to fix it.
So long as developers abide by the rules of the ESRB, PEGI, or CERO, Nintendo won’t interfere.

The U.S. has different rules from Japan on the amount of sexual content you can include in a "T" rated game, so unless the game is "M" rated they have to remove sexual content sometimes. That's not Nintendo's fault, it's the government's fault. The only exception is Fatal Frame, but that's also an ESRB rating thing. The ESRB rating did not include a "sexual content" warning, so they can't add sexual content via DLC.

In Japan, CERO has actual legal authority over what can get published and where it can be sold based on their ratings. ESRB and PEGI have no such authority, and technically their ratings are purely for reference. However, in practice many outlets decide whether to sell a game based on its rating, so publishers still have an incentive to seek as low a rating as possible.
It won't be hard, they stumbled really hard this gen, but they could easily come back in the next one.

While Sony can ban third parties from putting certain content on PlayStation, the flipside is that Sony cannot force those third parties to publish their games on Sony platforms. So what that means is the fans of these games might be better off engaging with the publishers rather than Sony. Push them toward Steam or something.
