Law isn't really about facts, there is a lot to interpretation and interpretations are inherently subjective.
If Nintendo convinces enough judges to side with them, emulation may become illegal.

I own a copy I bought in the 90s. The ease of buying it on a modern console (and applies to most of Nintendo's IPs) does not outweigh the price they charge - hence emulation.

It is and it isn't. In the business world there is may levels of both in use. I work with a AS400 mainframe daily. It does not run on the original AS400 hardware, but a CPU that is partially compatible and has emulation for the rest of the stack. And even for x86 virtualization quite a few opcodes are emulated, even when your chip has hardware accelerated extensions, that just lessens the amount of emulated code, but does not eliminate it.
Emulation is found in many more places then you may expect user, its not just about running your NES games on a PC.
