Was their stuff any good
Can they do that? Isn't he protected by the parody act or something?
I love fucking your mom
inb4 blizzard announces another lgbt character to flood blizzard related news
big corporations can do whatever they want
>steal assets
>get punished
wtf blizzard?
it was that recent horse scene wasn't it
Why them and not literally anyone else. I draw WoW porn, should I expect an email?
remember sony vs bleem? what bleem did was 100% legal but they still shut down anyways because sony fucked them up the ass with court fees to make them bankrupt.
>(((Blizzard)))
Have they ever made anything remotely decent besides SC & BW?
see why else do you think article 13 exists?
it only went through eu first because it's they're the first step
>hack 'artist' has to get a real job
awwww, poor baby
What said.
If they were original models it would be harder to close, but using official assets is just asking for trouble.
>draw sexist offensive shit
>wonder why companies don't want you in the community
Blizzard did the right thing. Companies don't need to tolerate offensive porn artists ruining their image.
Yeah, that's my thinking. On what grounds can they even call for a C+D? FYI Blizzard Ive dropped a metric ton of semen to Draennai(?) and I aint stopping.
You have to prove fair use in court. Guess who has more money for lawyers
lmao, when will they learn that content on the internet cant be controlled when it is so popular as wow porn?
Bleem?
He's making money off their characters by taking commission to produce porn for different clients. I don't know the full details but maybe he crossed the line recently. They can easily claim copyright infringement.
Meanwhile cucks on Yea Forums will defend big vidya corporations to death for their right to jew them.
Fuck Blizzard
yeah rexx does some nice stuff, hes also one of the very first wow porn content creators
Yeah he's pretty good.
Rexx is probably one of the oldest running WoW porn guys.
Blizzard owns and controls assets of their game. The artist is a thief for using them.
they made a ps1 emulator for pc and dreamcast. sony sued them multiple times. bleem won all lawsuits but the court costs made them bankrupt so in the end sony won.
>sony vs bleem
The courts ruled in favor of Bleem, thereby making any case going forward much easier and less costly because of precedent. Truly heroes before their time.
They can't, too bad they can use legal loopholes to bleed creators dry with court fees before that can be proven!
I mean I never said I supported Blizzard on this, just explaining why may've been the reason for the attack. There's a fuckton of people making OW and Blizzard porn, if only this one is being closed is most likely due an easier way to do it.
I'd say there's way worse offenders than him, he just was an easy target.
Companies have no say in the matter. An artist has no say over interpretation, parody, critique, or original ideas spawning from theirs, such as your characters fucking doggy style.
His twitter is deleted and his Patreon have show him deleting everything he made and leaving only two paragraph behind. And still have the fucking guts to locked it behind Patreon. patreon.com
true, but they tried the same thing with overwatch porn, and that went nowhere.
inb4 retards fall for this
This! I crossed my legs extra hard and held my coffee cup with both hands so contently while reading this! I might just post it on the Mary Sue!
They have the right to protect their IP. They probably see the pron as an "attack". Little do they know that pron is the only thing that is keeping utter shit like OW alive.
>What is creative commons license for Parody
You don't get to decide something isn't parody because it isn't enjoyable to you.
But why?
SFM porn is literally the only good thing coming out of their games these days. Are they fucking retarded?
>I draw WoW porn, should I expect an email?
you're not ripping off wow models, so no
>1400 sad fucks give money for this shit
just as bad as trannies, feminists and basedboys and politicians
Where can I see his stuff for free?
I think you are given a lawyer representative for free if you can't afford one. If what he's doing really is protected by law, then even the cheapest lawyer could technically pull him through.
That's why they have to take it down user, it looks bad whenever the porn of your games is bigger than your game
I'm sure there's a legal grey area between using official copyrighted assets to make patreon revenue
I understand what they think. I'm wondering what legal grounds they think they possibly have when put up against a Creative Commons law. Porn has been successfully defended as parody multiple times, profit has nothing to do with it either way.
nice
D1, D2, WC2.
isn't the issue that he is literally using blizzard assets instead of creating his own?
THEY TOLD ME I WAS CRAZY FOR DOWNLOADING PORN IN 2K19, BUT SEE WHO'S LAUGHING NOW? HAHA
But what about those "This ain't Batman XXX" movies? They're pretty much doing the same and making money of of it and they're.
>SFM garbage
>"artist"
good riddance
>you are given a lawyer representative for free if you can't afford one
not in civil suits
"artist"
he's editing the official models and making money from it
Blizzard can't order artists to 'cease' their work. Parody and transformative art is protected under fair use.
Blizzard really is afraid of people making their characters attractive
parody is fine if it's OC assets. it's not fine if you're literally copypasting models from the game.
Huh. Good thing I animate mostly Elizabeth and Lara porn.
POST THE FUCKING PORN
As has been mentioned multiple times legal grounds have nothing to do with it, American corporations are simply above the law when it comes to dealing with individuals.
How can movie commenters use raw clips of movies for parody and critique and have that be defensible, but an artist rearranges the models and animations himself and it isn't defensible?
That is the big question Blizzard has to answer.
Would this have happened if they made the models from scrap?
Companies absolutely can control how their property is used. Blizzard has child-friendly image and has all rights to keep it that way. Parody rule doesn't mean people can draw/do anything that hurts the image. They can remove porn artists from the community if they want.
@458283276
>comes into a thread about an artist he knows nothing about
>blatantly baits for attention
Just transition already since you crave attention so much.
kys faggot not even worth the (you)
A fellow connoisseur.
That's not how it works, retard
Sony was paying for all legal expenses, it's just that past a certain point, the Bleem guys couldn't bother with court shit anymore
because they say so
in practice they can't because youtube will nuke it
>intentionally sex up your characters to attract players
>shut down people who promote you and you're not even paying them
Imagine how less popular WoW would be if no female character ever showed skin
Riddle me this retards, if he was using ripped models how was he making porn from them.
I don't think blizzard would give their models tits and vaginas.
So much WoW/Overwatch porn out there. Do threy really want to sue everybody?
Jeeze
How long until someone starts dumping?
I'm all for freedom of porn fanart, but this was just another asset ripper SFM "animator". Nothing of value.
using movie clips falls under fair use if it meets specific criteria. copypasting files from a copyrighted video game to turn into porn is not fair use.
That is not true, and the whole of YouTube exists to prove you wrong.
No not really. Maybe the company or entity will go bankrupt, but as the Bleem decision shows, the courts will do what is right. However, sometimes you have to martyr yourself for legal precedent.
I doubt this guy has even contacted a lawyer, since he immediately took down the posts, which looks to a jury like an admission of guilt.
Would tweaking the original models in some way using a 3D modeling software (making different clothing etc) make them OC enough?
Yes.
For two main reasons: using copyrighted material that harms a brand and isn't educational isn't protected. Most criticism, parody, and satire falls under protection. You can get around this usually by changing the content enough that it's objectively the subject being discussed.
Also, you usually can't reproduce copyrighted material and sell it. This has been a thing since the dawn of the internet since its considered "published". The first time it was a big thing was when Interview With a Vampire came out and people wrote a ton of gay fanfics. Anne Rice had copyrighted their characters and their likenesses to stop this and eventually the IWaV fanfic sites disappeared and became replaced with mailing lists.
t. finishing a novel and in talks trying to get approval for copyrighted material from manufacturers to use their liscence.
The problem isn't that he is making porn of their characters, the problem is he is making a shit load of money off copyright characters.
They can remove porn artists from THEIR community, but they have no legal say in an individual producing pron with their character likeness. Sorry but in USA we have freedom of speech that allows individuals to express themselves in such a manneer.
yes, it works rather well if they sue the big names
and then when the big names are gone the shitty will be left and thus the porn will die
Fair use is dead, using a one second clip from something else will get it instantly taken from you.
It's a shit law. Weird Al shouldn't have been able to make a career out of making parodies of other people's music. And these artists shouldn't be able to make money on patreon for drawing fan art of characters they didn't create.
>Can they do that? Isn't he protected by the parody act or something?
Dosnt matter, the law is what big corporations can pay for, not what is legislated
They're only nabbing him because he's making a considerable amount of money from using copyrighted assets.
Wrong.
Japan loves porn artist draw porn of their IPs because more people buy more things fro m the real company.
The west are cucked pussies that dont know what makes money and brings in fans.
Pretty stupid move on Blizz's part. The porn keeps the game on some people's mind.
>not hiring the artist to your animation team while also allowing him to create official porn on the side, taking a cut of his commission
It’s like Blizzard doesn’t even want to be cool.
the fair justice of america, everyone
I'd be angry if it wasn't towards a degenerate : when they create their characters, they don't want it to become a cashgrab for immoral weirdos who make money on their back.
The guys supporting this "artist" only do so because they're pervs too.
But blizzard characters are already attractive
>they have no legal say in an individual producing pron with their character likeness
They do when the artist is a thief making money with them.
Big porn studios have VERY good lawyers, corporations wouldn't go after them.
you wouldn't be able to quote books, you wouldn't be able to quote speeches as they are written by speech writers, everything would be shit.
Those movies, at least the ones by professional porn sites, never explicitly state that it's actually batman, or any other IP fot that matter. It's very obviously a parody.
>profit has nothing to do with it
Not exactly. Sure you can make money by doing a porn parody, but it is very clear that it is a parody. This is a lot closer to home.
I have never heard of anyone being sued over drawn porn by gaming companies. There you can clearly differentiate between the artist's input and what comes from the game. Here less so.
But I don't really know US law and it's famously fucked.
ok, i wont buy your product then, mr corporate
I mean, not really. I'm assuming the details are going to be hammered out by lawyers, but basically he's using their assets to make money.
>Retard on his patreon actually believes that using stolen model rips counts as "fanart"
Blizzard is a feminist company now user.
and people still trust Blizzard to not fuck up Classic
That's not how freedom of speech works, you retard. The first amendment doesn't give you the right to create what ever smut you want to create.
There's a big difference between japanese pedo company for adults and western child-friendly company for children.
This reminds me of the Erin Esurance chick and how they kinda stopped using her because of porn. Also because she was never meant to be a permanent thing but yeah the porn didn't help
but aren't feminists pro-sex n shit?
would dressing up mickey mouse mean its not mickey mouse?
in before Blizzard adds/retcons another trannie into WoW to spin all the news about Blizzard into WOOOOW SO PROGRESSIVE again. Maybe Warchief Thrall has a feminine penis now
this fella?
>send a bunch of c&d letters out for Overwatch's launch
>nothing happened and tons more smut was made
What's the difference here?
No they aren't
Sony is a feminist company, blizzard were just dumb enough to think they could make money by pretending to be sjws.
>paying for porn
poor pay pigs
weird al gets written permission before he does a parody
Using the models for porn quailifies as transformative.
Courts weigh four factors when determining whether a particular use of another’s work is a “fair use.” The first factor evaluates “the purpose and character of the use.” This requires a determination of whether the use is for commercial gain or nonprofit (e.g., educational) endeavors. The fact that a work is for commercial gain does not automatically remove it from the umbrella of fair use, but a non-profit purpose does more strongly tip the scale in favor of fair use. The second factor assesses “the nature of the copyrighted work.” Here, there is an examination of the type of work which has been taken. For example, a copying of facts is more likely a fair use than a copying of fiction, since dissemination of facts is considered a desirable benefit to the public. The third factor measures “the amount and substantiality of the portion taken.” A copying of a small percentage of a work is more likely a fair use than a verbatim copying of the entirety. Finally, the fourth factor weighs “the effect of the use upon the potential market.” If a work “supersedes” the original work by making it unnecessary to purchase the original, that will lean towards a lack of fair use.
>The fourth point is probably why Blizzard is doing this, because instead of booting the game to jack off I can just do it on a R34 site
But here is the PERFECT defense for Rexx. How could Blizzard ursurp this court decision;
CONTINUED IN PART 2
His SFM isn't even that good, noname55 is way better.
They are if it benefits them.
They're not if it's related to something they don't like.
he most certainly does/did not for some songs
Stupid dogfucker.
You sound like a hack who makes royalty free music because no one even actually wanted to pay for your shit compositions.
based retard
people got reminded that OW porn still exists
>everyone in this thread outplayed by blizz's 4D chess moves
Based dogfucker.
m-moar?
this site is for people who are over 18
>in the 1981 case of Pillsbury Co. v. Milky Way Productions, Inc., an image published in “Screw” magazine portraying the Pillsbury Doughboy character in sexual acts, when challenged as a copyright infringement, was found to be fair use. The U.S. District Court for the Northern District of Georgia determined that the use “…is more in the nature of an editorial or social commentary than it is an attempt to capitalize financially on the plaintiff’s original work. Although the portrayal is offensive to the court, the court has no doubt that Milky Way intended to make an editorial comment on the values epitomized by these trade characters.” The court observed that the plaintiff failed to introduce more than a “sliver of evidence” showing economic harm, and consequently, refused to fill the void by presuming such harm.
>In 2002, in Lucasfilm Ltd. v. Media Market Group, Ltd., the U.S. District Court for the Northern District of California dismissed a motion for preliminary injunction against the sale of an animated porn parody called “Starballz.” The court explained that “‘Starballz’ is a parody of Star Wars, in that it is a ‘literary or artistic work that broadly mimics an author’s characteristic style and holds it up to ridicule.’” The court pointed to the Campbell case, explaining “[t]he Supreme Court has stated that for the purposes of copyright law, ‘the heart of any parodist’s claim to quote from existing material is the use of some elements of a prior author’s composition to create a new one that, at least in part, comments on that author’s works.’” The court indicated that the parodic nature of “Starballz” may be fair use.
SO is Blizzard bigger than Pillsbury or Lucasfilm at its prime?
He doesn't use SFM
he uses C4D
his shit was top notch tho nigga
>unironically liking the dogfucker
Jesus man.
based truth
chan.sankakucomplex.com
Oh brother were have you been, I don't save /pol/ memes, but I'm sure there's compilations of "progressive" game devs spewing their opinions that sound more and more Muslim every day.
no one gives a shit. blizzard will bully this nigga in court tll he runs out of money.
>not liking honoka getting dogged or horsed
Yikes!
this
It's basically taking an artwork, modifying it and selling it as your own.
But the difference is that when an artist of the original would possibly lose money, Blizzard isn't losing anything by letting him do this, because they don't make money off porn. So it's still kind of annoying move from them.
Weird Al gets permission for every song. The only time he apparently "didn't" was for Coolio's Amish Paradise parody, but he maintains that he got permission but Coolio didn't like the end result after it was released.
That's what that faggot gets for spamming the animation tag with 40 pages of WoW shit
No I meant the character named Erin Esurance
