This has been tried and tested and the courts agree. In the early 90s a certain ISP was taking small fragments of files of the users computer and sending the files to themselves (this was when the internet was always through a launcher like CompuServe, Prodigy, and AOL). They took those files, parsed them, and used them for targetting advertising.

That ISP vanished after 1995 because they got fucking annihilated in courts. The main reason is those personal files on your computer contain truly personal infomation - credit card numbers, social security numbers, passwords, extremely private data.

And that is why no TOS will ever give legal permission to steal shit from your computer outside of it's designated folders, which are specific to each operating system and don't mean anywhere on the drive.

You MUST give EXPLICIT consent BEFORE they copy the files. They can't wedge it into the middle of a 10-page TOS.
