the whole point of the game is that you don't have to fight anyone, so turning the character into a generic fighter defeats the whole message of the game. especially since undertale fans would be pissed off about that since they give people shit for not doing the pacifist route on their first playthrough.

The point is that you can choose whether to fight or not. Also you can literally attack every enemy you come across and still get pacifist. Smash has plenty of non-murderers already on the roster.

Frisk doesn't have to follow that concept at all. No route forces you to never attack anyone, so I don't see how Frisk couldn't be a fighter.

The pacifist route isn't completely perfect, because not only you HAVE to fight both Flowey and Asgore, but you also have the option to either kill or spare Flowey, and, that choice doesn't affect the pacifist run at all. You can literally chose to kill Flowey, and would still get a Pacifist Run.

I don't think you understand how the process of getting a 3rd party character into Smash works. There are no "lawsuits" unless Sakurai and Nintendo would be dumb enough to put the character in without first obtaining the license from the IP holders.

That being said...
It's still not as simple as that. One Disney exec saying "yeah, we'd be cool with putting Sora in Smash" doesn't mean that he can straight up be in Smash. All it means is that Disney is willing to negotiate terms to include him if Nintendo wants to use him. It could still very easily fall apart because Disney could make unreasonable demands or want too much of a cut or up front cash before giving licensing rights. Or maybe Nintendo/Sakurai would want to do something with the character that Disney, and to a lesser extent, Square, aren't ok with so they could take the offer back or Nintendo may just be unwilling to use him if they can't do a particular thing with him. Sora is a much more complicated case than you realize due to his jointly owned franchise, the fact that Disney is fucking MASSIVE, and, just how many things need to be considered when creating a fighter that faithfully represents his series, not to mention the music, which Square has already demonstrated that their composers are difficult to negotiate with. Even if Disney would be cool with Sora getting in, it's a pretty uphill battle to actually make it happen, and as such, his chances are not so great. Not impossible, but they aren't great.
