Skyrim Together has a member on the team that has been blacklisted from using SKSE for stealing it’s code multiple times over. When he joined the mod team that blacklist carried over so the mod wasn’t allowed to use SKSE at all and the team said they knew this.
The closed-beta (which was access via a “donation” to their patreon, which is fine in Beth’s eyes as they didn’t use the CK) had a bunch of code of SKSE in it, making it an illegal mod.

You keep falling on this, when that's not what happened. Patreon donators got early access, this is typical of any project through the platform. The project was not locked behind donations, after a mere few weeks anybody would have gained access to the project. Ergo that's not a paywall, it's timed exclusivity.

I think another problem is that even if they make the mod free they have gotten real cagey about letting people run their own servers. All parts of a mod have to be free so if they don't allow people to run their own servers or keep it behind a paywall then the mod becomes a paid mod and that is against Bethesdas TOS.
The mod police will come and get you while saying mean things.

I don't think Bethesda has the legal grounding to "give" copyright to anything, copyright is always given to the creator and falls under "literary works" in the Copyright Act.

Not putting an explicit license in your code is very bad practice and just leads to this kind of fuckery, no serious company ever uses licenseless code in their software since the original creator can throw a tantrum and sue them.

The artwork would fall under its own copyright, there's no law dictating specifically what a mod package falls under.
It can get messy too, if an artfag in a modding team decides to be a fag he can disallow the rest of the team from using his art unless they signed a contract explicitly giving away the license.
