It´s not like I know japanese criminal law but I feel qualified enough to say that whether death penalty is applicable depends on whether the culprit fulfilled all aspects of a crime that allows a death penalty. Only items No. 1, 3 and possibly 4 of that list seem like appropriate to that effect. The rest are aggravating circumstances that would allow to to impose a more severe punishment but only within allowed bounds. That being said, if a mass premeditated murder commited through horrific means do not qualify as sufficient for sentencing someone to death, I don't know, what could. I'm all for hanging Shinji-kun. I'm just a little bit afraid that considering his rumored lacking mental health he could be found to be acting under diminished sanity (if Nip criminal law knows this legal institute, it's pretty common), which would allow for a lesser punishment, in his case probably a life sentence.
